Terms and Conditions for Bookings

Everyone in our team is dedicated to ensuring that all of our guests have an enjoyable time with us. To enable us to ensure this, we hope that you will understand that we can only take bookings for our restaurant on the following terms and conditions:

1. Scope and application The following provisions shall apply to all bookings at the “Nobelhart & Schmutzig” restaurant, owned by Billy Wagner KG.

2. Bookings and cancellations Due to the fact that our restaurant only has a limited number of seats, and all of the food on offer is prepared freshly and with great care, we are unfortunately unable to offer much flexibility when allocating and reserving the available seats. We shop for fresh ingredients every day, based on the bookings we have. When we have larger bookings in particular, we are regularly forced to turn down other customers. Bearing all this in mind, the losses that are incurred by us if a booking is either not honoured, or where a booking is cancelled at an unreasonably late stage are considerable. It is for this reason that we hope that you will understand that we reserved the right to minimise those losses, if applicable, as per the following provisions. We hope that you will also understand that we will not notify you separately in such an event.

2.1 We reserve the right not to accept bookings unless credit card details are provided to us. We shall be entitled to charge the price of the meal to the respective credit card (unless this is paid at the restaurant immediately after the meal), but we shall also be entitled to charge any compensation due (as per the following provisions) where applicable.

2.2 Bookings shall be binding with regard to the time and the number of seats booked (i.e. the number of guests). However, it is possible to cancel a booking free of charge, either in its entirety or in part (i.e. in respect of individual guests) up to 48 hours before the time booked.

2.3 If a booking is not cancelled by the point in time stipulated in section 2.2, then we shall be entitled to charge a fixed compensation fee of € 105 (Thursdays, Fridays and Saturdays as well as the evening before bank holidays € 130) for each guest who does not turn up, or who cancelled late, unless we are able to fill that guest’s place with another (paying) guest. The same shall apply if your booked seats are not taken at the agreed time- i.e. where guests either do not turn up at all, or where a smaller number than booked turn up.

2.4 In the event that any such late cancellation or failure to take the seats that were booked is the result of circumstances beyond your control, we shall not be entitled to claim such compensation. Moreover, you are at liberty to prove that your late cancellation or failure to appear did not result in us incurring any loss or that any losses thus incurred are significantly lower than the fixed compensation as per section 2.3.

2.5 Where the reserved seats are not taken 30 minutes after the allocated time at the latest (i.e. if the guests who had booked have failed to appear) we shall be entitled to allocate these seats otherwise. Sections 2.3 and 2.4 shall also apply in such cases. However, any income revenue generated by us as a result of allocating the seats otherwise shall and will be set off against any compensation due to us as per section 2.3.

2.6 If you have made a large booking (more than 10 seats), you may cancel your booking or reduce the number of guests free of charge, up to 5 days before the date. Where a cancellation is not made by the point in time stipulated above, we shall be entitled to charge a fixed compensation fee of € 105 (starting May 3, 2018 Thursdays, Fridays and Saturdays as well as the evening before bank holidays € 130) for each guest who does not turn up, or who cancelled late, unless we are able to fill that guest’s place with another (paying) guest.
